In these terms and conditions:
The "Company" means Commercial Fitness Equipment
The "Customer" means the customer referred to overleaf.
"Products" means the goods specified overleaf and/or the goods to which this invoice relates.
"Product Price" means the purchase price of the Products and any costs payable in connection with the delivery of the Products (including but not limited to any delivery and freight charges, insurances and any other charges, duties, taxes, fees or expenses incurred in connection with the purchase or delivery of the Products). 

Terms of Supply

All products sold or supplied by the Company to the Customer are sold on these terms and conditions. These terms and conditions (which can only be waived in writing by the Company) shall prevail over the terms and conditions of the Customer's order to the extent of any inconsistency. 

Shipping and Delivery Policy

We deliver products using Multiple Carriers. Shipping costs are influenced by the size and weight of the product and your location. Exact shipping costs are calculated in the shopping cart and will be added to the order total before checkout.  All shipping costs are calculated based on delivery being to a commercial premises and not a residential address. Deliveries to residential addresses will incur extra costs.

 

Shipping Destinations

Commercial Fitness Equipment ships goods Australia wide and internationally, however at this time we do NOT accept international orders through our website. Please contact us on 1800 006 526 to enquire about a special order.

 

Refund Policy

To further assist you to make a risk free purchase, we back our products with a 14 Day Money Back Guarantee.

If for any reason you decide that you don’t want the item you have purchased, which includes “I have changed my mind and don’t want it”, you can send it back to us within 14 days of your purchase date. That’s right we will give you a full refund for the purchase price of the product. Our purpose is to help you build a strong, viable business, not force you to keep equipment you don’t need.

The products must still be in the original packaging, in new condition and not used.

Once the item(s) have been returned we will process a refund via your original payment method.

The initial delivery and/or installation costs are not covered in the Money Back Guarantee, nor are the cost to return the item to our store or warehouse.

Our 14 Day Money Back Guarantee is only offered to purchases under $1,000 and not on items that have been specially ordered or manufactured.

If items are out of stock or cannot be supplied, then we will provide a full refund for those items if requested or exchange them for other products to the satisfaction of the purchaser.

 

Pricing Policy

All of our prices are in Australian dollars (AUD) and include GST (Goods and services tax) as of 1/7/14. Product prices are regularly updated when price changes are received from our suppliers. If you find a cheaper advertised price somewhere else, email or phone us with the details of the supplier together with prices of the product required and we will endeavour to provide you with a more competitive price.

We will always endeavour to provide the most competitive prices on fitness and gym equipment.Our Lowest Price Guarantee is simple and fair. We also check pricing throughout the marketplace and on-line to ensure we are competitive. If you find a lower advertised price on the same model we stock then please let us know at the time of purchase and we will match or better that price. All we require is the web address where it is advertised or a genuine written quote. The price Lowest Price Guarantee obviously does not apply to floor model prices or run out models. The other factor is freight costs as this will vary depending on locations.” 

 

Customer Service Policy

Commercial Fitness Equipment is committed to providing exceptional customer service and quality products.  We endeavour to make sure that all products listed on our website are currently in stock and pricing is true and correct. Standard delivery timeframes are between 3-10 business days; in the event that an ordered item is not available or we are unable to fulfil your order we will notify you within 2 business days to arrange an agreeable alternative item, a backorder or a full refund. 

Security Policy

When purchasing from Commercial Fitness Equipment, card details are transmitted through a secure server using PayPal or Eway Payment Gateway. Card data is not hosted or recorded by Commercial Fitness Equipment after processing.

 

Limitation of Liability

To the fullest extent permitted by law and except as specifically provided in these terms and conditions, all express and implied warranties and conditions under statute or general law as to merchant ability, description, quality, suitability or fitness for any purpose or otherwise are expressly excluded. If any warranty cannot be excluded then to the fullest extent permitted by law the Company’s liability shall, with respect to that warranty, be limited at the option of the Company to:
(a) the replacement of the relevant Products or the supply of equivalent Products; or
(b) the cost of replacing the relevant Products or acquiring equivalent Products.
To the fullest extent permitted by law the Company shall not be responsible or liable for any special, indirect or consequential loss or damage.

Waiver

Failure or neglect by the Company to enforce any of these terms and conditions shall not be construed as a waiver of the Company’s right or affect the Company’s right to take any subsequent action. 

Entire Agreement

These terms and conditions supersede and replace any arrangements, representations, understandings or agreements made or existing between the Customer and the Company and (except as otherwise may be agreed in writing) constitute the entire agreement relating to the supply of the Products. 

Governing Law

These terms and conditions shall be construed in accordance with the laws of Victoria, Australia.
